Short Title:        Tuition for Dependents of Deployed Military.

A BILL TO BE ENTITLED

AN ACT to provide in-state tuition at community colleges for one year to DEPENDENTS of members of the armed services deployed overseas.

The General Assembly of North Carolina enacts:

SECTION 1.  G.S. 115D‑39 is amended by adding a new subsection to read:

"(d)      In addition, any dependent relative of a member of the armed services not qualifying as a resident for tuition purposes under G.S. 116‑143.1 is eligible for the State resident community college tuition rate under the following conditions:

(1)        The member of the armed services was stationed in North Carolina within the preceding 10 years.

(2)        The member of the armed services is currently or has received orders or other official documentation deploying that member overseas within the next six months for a deployment to exceed one year.

(3)        The dependent relative resides in North Carolina as a result of the member's deployment.

(4)        The dependent relative is sponsored by a North Carolina resident who provides a signed affidavit to the community college verifying that the North Carolina resident accepts financial responsibility for the student's tuition and any other required educational fees.

A dependent relative is eligible for the State resident community college tuition rate under this subsection for no more than 12 months. A North Carolina resident may sponsor no more than two nonresident students annually under this subsection. For purposes of this subsection, the term "armed services" shall mean the United States Air Force, Army, Coast Guard, Marine Corps, and Navy, the North Carolina National Guard; and any Reserve Component of the foregoing."

SECTION 2.  This act becomes effective July 1, 2011, and applies beginning with the 2011‑2012 school year.
