A BILL TO BE ENTITLED

AN ACT to increase the rate paid for personal care services provided to medicaid and NC Health Choice recipients.

The General Assembly of North Carolina enacts:

SECTION 1.  Beginning January 1, 2018, the Department of Health and Human Services, Division of Medical Assistance, shall increase to four dollars and twenty‑five cents ($4.25) the fifteen‑minute rate paid for personal care services provided pursuant to Clinical Coverage Policy 3L.

SECTION 2.  The rate increase under Section 1 of this act will affect only half of the 2017‑2018 fiscal year. There is appropriated from the General Fund to the Department of Health and Human Services, Division of Medical Assistance, the sum of seventeen million nine hundred seventy‑nine thousand one hundred twenty‑two dollars ($17,979,122) for fiscal year 2017‑2018 and thirty‑seven million three hundred eighty‑five thousand five hundred forty‑four dollars ($37,385,544) for fiscal year 2018‑2019 to implement the rate increases authorized under Section 1 of this act. These funds shall provide a State match for an estimated thirty‑seven million five hundred twenty‑nine thousand one hundred twenty‑six dollars ($37,529,126) in federal funds for the 2017‑2018 fiscal year and seventy‑eight million thirty‑seven thousand five hundred sixty‑one dollars ($78,037,561) in federal funds for the 2018‑2019 fiscal year, and those federal funds are hereby appropriated to the Division of Medical Assistance to pay for costs associated with the rate increase under Section 1 of this act.

SECTION 3.  This act becomes effective July 1, 2017.
