A BILL TO BE ENTITLED

AN ACT to DIRECT THE LEGISLATIVE RESEARCH COMMISSION TO STUDY THE prohibitION OF community appearance commissions, cities, and counties from requiring that nursery stock that is purchased within the jurisdiction of the Commission, city, or county respectively meet any standard for nursery stock that is stricter than THE AMERICAN STANDARD FOR NURSERY STOCK ADOPTED BY THE AMERICAN NURSERY AND LANDSCAPE ASSOCIATION, UNLESS THE STRICTER STANDARD IS NECESSARY TO PROTECT PUBLIC HEALTH OR SAFETY.

The General Assembly of North Carolina enacts:

SECTION 1.  The Legislative Research Commission shall study whether community appearance commissions, municipalities, or counties should be prohibited from requiring that nursery stock purchased to be planted within the jurisdiction of the commission, municipality, or county satisfy any standard for nursery stock that exceeds the American Standard for Nursery Stock adopted by the American Nursery and Landscape Association, unless the stricter standard is necessary to protect public health or safety. The Commission shall make a report on this issue, including any recommendations or legislative proposals, to the 2013 Regular Session of the General Assembly when it reconvenes in 2014.

SECTION 2.  This act is effective when it becomes law.
