A BILL TO BE ENTITLED

AN ACT to appropriate funds to the division of Mental Health, Developmental Disabilities, and Substance Abuse Services of the department of health and human services to restore state‑funded services provided through local management entities, as recommended by the joint legislative oversight committee on Mental Health, Developmental Disabilities, and Substance Abuse Services.

The General Assembly of North Carolina enacts:

SECTION 1.  There is appropriated from the General Fund to the Department of Health and Human Services, Division of Mental Health, Developmental Disabilities, and Substance Abuse Services, the sum of forty million dollars ($40,000,000) for the 2010‑2011 fiscal year.  These funds shall be used to increase the amount of State service dollars allocated for State‑funded services provided through local management entities (LMEs).  The amount of State service dollars allocated to an LME pursuant to this section shall be (i) identical to the amount by which State service dollars were reduced on a nonrecurring basis for that LME during the 2009‑2010 fiscal year, and (ii) used by the LME only to restore State‑funded services provided by the LME prior to enactment of the budget reductions for the 2009‑2010 fiscal year.

SECTION 2.  This act becomes effective July 1, 2010.
