A BILL TO BE ENTITLED

AN ACT to clarify the applicability of S.L. 2010‑13, an act to improve the success of fishery Management plans, as recommended by the joint legislative commission on seafood and aquaculture.

The General Assembly of North Carolina enacts:

SECTION 1.  Section 2 of S.L. 2010‑13 reads as rewritten:

"SECTION 2.SECTION 2.(a)  This act is effective when it becomes law.

SECTION 2.(b)  Subdivision (5) of subsection (b) of G.S. 113‑182.1, as enacted by Section 1 of this act, shall not apply to the Fishery Management Plan for Spotted Seatrout submitted by the Secretary of Environment and Natural Resources to the Joint Legislative Commission on Seafood and Aquaculture on August 23, 2010.  Subdivision (5) of subsection (b) of G.S. 113‑182.1, as enacted by Section 1 of this act, shall apply to the Fishery Management Plan for Spotted Seatrout for all subsequent reviews and revisions of the Plan.

SECTION 2.(c)  Notwithstanding G.S. 113‑182.1(d), the Marine Fisheries Commission shall review the Fishery Management Plan for Spotted Seatrout no later than January 1, 2014."

SECTION 2.  This act is effective retroactively to June 23, 2010.
