Senate Concurrent Resolution 566

A CONCURRENT RESOLUTION PROPOSING AN AMENDMENT TO SECTION 97, MISSISSIPPI CONSTITUTION OF 1890, TO REVISE THE CONSTITUTIONAL PROHIBITION AGAINST LEGISLATIVE REVIVAL OF A REMEDY BARRED BY LAPSE OF TIME.

     BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI, That the following amendments to the Mississippi Constitution of 1890 are proposed to the qualified electors of the state:

     Amend Section 97, Mississippi Constitution of 1890, to read as follows:

     "Section 97.  The Legislature shall have no power to revive any remedy which may have become barred by lapse of time, or by any statute of limitation of this state, except under exceptional circumstances as may be determined by the Legislature."

     BE IT FURTHER RESOLVED, That the amendment in this resolution shall be submitted to the qualified electors at an election to be held on the first Tuesday after the first Monday of November 2010, as provided by Section 273 of the Constitution and by law.

     BE IT FURTHER RESOLVED, That the explanation of the amendment for the ballot shall read as follows:  "This amendment provides that the Legislature may by statute extend the statute of limitations under exceptional circumstances."
