AN ACT TO AUTHORIZE THE GOVERNING AUTHORITIES OF THE CITY OF ROLLING FORK IN SHARKEY COUNTY, MISSISSIPPI, TO EXPAND ITS WATER DISTRIBUTION SYSTEM WITHIN CERTAIN AREAS THAT ARE MORE THAN FIVE MILES OUTSIDE THE CORPORATE LIMITS OF THE CITY OF ROLLING FORK; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1. (1) Notwithstanding any provisions of Section 21-27-39, Mississippi Code of 1972, to the contrary, the governing authorities of the City of Rolling Fork, in Sharkey County, Mississippi, may, in their discretion, construct, expand, operate and maintain the water distribution system of the City of Rolling Fork in the following areas that are more than five (5) miles from the corporate limits of the City of Rolling Fork:

Tract 1

Beginning at the Northwest corner of Section 15, Township 13 North, Range 6 West, Sharkey County, Mississippi, Run thence South for 1.0 mile, thence East for 1.5 mile, thence South for 0.5 mile, thence West for 0.5 mile, thence South for 0.5 mile, thence East for approximately 0.5 mile to the centerline of the Sunflower River, Run thence Northerly along the centerline of the Sunflower River to it's intersection of the North Line of the South Half of the South Half of Section 11, Run thence West for approximately 2200 feet to the East line of the West Half of said Section 11, Run thence South for 0.25 mile to the South Line of said Section 11, Run thence West for 1.5 miles to the Point of Beginning.

The above described tract being situated in Sections 11, 14, 15 & 23, Township 13 North, Range 6 West, Sharkey County, Mississippi.

Tract 2

Beginning at the Southwest corner of the Northeast Quarter of Section 35, Township 13 North, Range 6 West, Sharkey County, Mississippi, Run thence East for 0.5 mile, thence North for approximately 2600 feet to the centerline of the Sunflower River, Run thence Northwesterly along the centerline of the Sunflower River to it's intersection with the East Line of the West half of Section 26, Run thence South for approximately 2900 feet to the point of Beginning.

The above described tract being situated in Sections 26 & 35, Township 13 North, Range 6 West, Sharkey County, Mississippi.

Tract 3

The Southwest Quarter of Section 3 and the Southeast Quarter of Section 4, Township 11 North, Range 7 West, Sharkey County, Mississippi.

(2) Whenever such water utility service is furnished to any consumer residing outside the corporate limits of the City of Rolling Fork, the consumer may not be charged at a rate greater than twice the rate charged for the same service within the corporate limits of the City of Rolling Fork.

(3) The authority conferred by this act shall not be construed as an exemption from the provisions of Section 77-3-1 et seq., Mississippi Code of 1972, as to the requirements for obtaining a Certificate of Public Convenience and Necessity, the jurisdiction of the Public Service Commission to regulate rates or any other provisions of that law.

SECTION 2. This act shall take effect and be in force from and after its passage.
