AN ACT TO AUTHORIZE THE CLARKSDALE PUBLIC UTILITIES COMMISSION TO TRANSFER FUNDS TO THE CITY OF CLARKSDALE, MISSISSIPPI, IN AN AMOUNT REQUESTED BY THE GOVERNING AUTHORITIES OF THE CITY NOT TO EXCEED 6% OF THE TOTAL OPERATING REVENUE OF THE COMMISSION; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  The governing authorities of the City of Clarksdale, Mississippi, are authorized and empowered by resolution to request funds from the Clarksdale Public Utilities Commission in an amount not to exceed six percent (6%) of the total operating revenue of the commission as determined by the prior fiscal year audit.  The Clarksdale Public Utilities Commission shall transfer to the City of Clarksdale the amount requested in the resolution minus any amounts provided to the city as free services pursuant to Section 21-27-27, Mississippi Code of 1972.  The transferred funds may be used by the governing authorities of the City of Clarksdale for any lawful municipal purpose and may be distributed to the various municipal funds.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
