Senate Bill 2830

AN ACT TO ESTABLISH A PROCEDURE FOR AIRPORT AUTHORITIES AND MUNICIPALITIES TO ENFORCE AIRCRAFT LIENS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  An authority shall have a lien upon all aircraft landing upon any airport owned or operated by the authority for all fees and charges for the use of the facilities of the airport by any aircraft when payment of the charges and fees is not made immediately upon demand to the operator or owner of the aircraft by an authorized employee of the airport.  The lien for the full amount of the charges and fees due attaches to any aircraft, at the airport, which is owned or operated by the person owing the charges and fees.  The lien may be enforced in the same manner as provided by Sections 85-7-31 through 85-7-53.

     (2)  A municipality shall have a lien upon all aircraft landing upon any airport owned or operated by the municipality for all fees and charges for the use of the facilities of the airport by any aircraft when payment of the charges and fees is not made immediately upon demand to the operator or owner of the aircraft by an authorized employee of the airport.  The lien for the full amount of the charges and fees due attaches to any aircraft, at the airport, which is owned or operated by the person owing the charges and fees.  The lien may be enforced in the same manner as provided by Section 85-7-31 through 85-7-53.

     (3)  A person may not remove or attempt to remove from the airport any aircraft owned or operated by the person owing the charges or fees after service of notice of the lien upon the owner or operator or after the posting of the notice upon the aircraft.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
