Senate Bill 2755

AN ACT TO PROVIDE THAT CERTAIN INFORMATION MAINTAINED BY THE MISSISSIPPI DEPARTMENT OF CORRECTIONS SHALL BE EXEMPT FROM DISCLOSURE UNDER THE MISSISSIPPI PUBLIC RECORDS ACT; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  No person shall have access to any records if the disclosure is deemed by the commissioner of the Mississippi Department of Corrections, or his designee, to constitute a threat to the security of the subject inmate, correctional staff, the institution or any other person.

     (2)  The department shall not be required to comply with a request for any record from any inmate confined in a jail or any facility or any individual on active supervision under the jurisdiction of the department.

     (3)  All records containing information expunged pursuant to law shall not be open to the public.

     (4)  The policies and procedures or administrative regulations of the department which address the security and control of inmates and penitentiaries shall not be accessible to the public or inmates.

     (5)  No person shall use the Public Records Act in an attempt to circumvent the normal discovery process of pending litigation with the Mississippi Department of Corrections.

     (6)  The department shall have additional time to respond to any lengthy or multiple request for records.

     (7)  All the records referenced in this section shall be exempt from the Mississippi Public Records Act of 1983.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2019.
