Senate Bill 2688

AN ACT TO CREATE A DRUG DROP-OFF AND DISPOSAL PROGRAM TO BE OPERATED BY THE BUREAU OF NARCOTICS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  There is created a drug drop-off and disposal program to be operated by the Bureau of Narcotics.

     (2)  The sheriff of any county is authorized but not required to participate as a drop-off location for the program.  From time to time, the bureau may designate other appropriate permanent or temporary drop off locations as are deemed necessary or advisable.

     (3)  The drug drop-off and disposal program shall have the following features:

          (a)  The sheriff's offices, or the Bureau of Narcotics on behalf of the sheriff's offices, shall seek approval by the United States drug enforcement agency to the extent necessary under federal law;

          (b)  There shall be adequate documentation of all collected unused medication;

          (c)  All unused medications shall be disposed of by the bureau in an environmentally safe manner;

          (d)  The program shall protect against the potential for the diversion of collected medications for unlawful use or sale.

          (e)  The Commissioner of Public Safety, in consultation with the Director of the Department of Environmental Quality and the State Health Officer, shall provide for public education to inform potential participating consumers about the availability of the drug-disposal program and the proper and effective disposal of unused medications;

          (f)  The bureau shall be responsible for the secure collection, storage, transport, destruction and disposal of controlled substances and all other medications collected under the program.

     (4)  The bureau shall promulgate rules and regulations implementing the requirements of this section.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2011.
