AN ACT TO AMEND SECTION 71-3-33, MISSISSIPPI CODE OF 1972, TO CLARIFY THAT ANYONE WHO HAS ATTAINED THE AGE OF 18 MAY RECEIVE THEIR OWN COMPENSATION AND MAKE DECISIONS REGARDING THEIR CASE UNDER THE WORKERS' COMPENSATION ACT; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. Section 71-3-33, Mississippi Code of 1972, is amended as follows:
71-3-33. The commission may
require the appointment by a court of competent jurisdiction, for any person
who is mentally incompetent or * * * less than eighteen (18) years of age,
of a guardian or other representative to receive compensation payable to such
person under this chapter and to exercise the powers granted to or to perform
the duties required of such person under this chapter. Any person who has
not proven to be mentally incompetent and who has obtained the age of eighteen
(18) years shall be permitted to handle the person's own affairs, receive
compensation in the person's name, or otherwise pursue the person's rights
under this chapter without the requirement of an appointed guardian or other
representative.
SECTION 2. This act shall take effect and be in force from and after its passage.
