AN ACT TO CREATE SECTION 63-3-1217, MISSISSIPPI CODE OF 1972, TO PROHIBIT THE CARRYING OF PASSENGERS IN A TRUCK BED OR OPEN CARGO AREA; TO ENACT EXCEPTIONS; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. The following shall be codified as Section 63-3-1217, Mississippi Code of 1972:
63-3-1217. (1) Every driver of a motor vehicle being operated in forward motion on any public road, street or highway is prohibited from carrying any passenger in a truck bed, open trailer, or in any open or uncovered nonpassenger or cargo area unless the passenger is over four (4) years of age and is:
(a) Occupying a passenger seat or seats manufactured or installed as an integral part of the vehicle; and
(b) Wearing a properly adjusted and fastened safety seat belt system that would comply with Section 63-2-1 for passengers occupying the front seat of a passenger motor vehicle.
(2) The provisions of this section shall not apply to the operator of a vehicle if the operator is traveling not more than fifteen (15) miles per hour while actually participating in a parade in a controlled situation.
(3) Violation of this section is a violation of the traffic regulations and rules of the road and shall be punished as provided in Section 63-9-11, Mississippi Code of 1972.
SECTION 2. This act shall take effect and be in force from and after July 1, 2012.
