AN ACT TO AMEND SECTION 99-19-107, MISSISSIPPI CODE OF 1972, TO CLARIFY THAT A PERSON WHOSE DEATH SENTENCE HAS BEEN HELD TO HAVE BEEN UNCONSTITUTIONAL SHALL BE SENTENCED TO IMPRISONMENT FOR LIFE AND IS NOT ELIGIBLE FOR PAROLE; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 99-19-107, Mississippi Code of 1972, is amended as follows:

     99-19-107. * * *In the event  If the death penalty is held to be unconstitutional as a whole by the Mississippi Supreme Court or the United States Supreme Court, or if a person's sentence to death has been held to be unconstitutional, whether on account of that person's membership in a particular class of offenders or for some reason particular to that person, the court having jurisdiction over a person previously sentenced to death shall cause * * *such the person to be brought before the court and the court shall sentence * * *such the person to imprisonment for life, and * * *such the person shall not be eligible for parole.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
