Senate Bill 2541

AN ACT TO CREATE THE OFFENSE OF RECKLESS ENDANGERMENT AND TO PRESCRIBE PENALTIES THEREFOR; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  A person who engages in conduct that places or may place another person in imminent danger of death or serious bodily injury and, while engaging in that conduct, consciously disregards a substantial and unjustifiable risk that death or serious bodily injury will result from his conduct commits the offense of reckless endangerment.

     (2)  (a)  Except as provided in this subsection, reckless endangerment is a misdemeanor punishable by a fine of not more than One Thousand Dollars ($1,000.00) and imprisonment in the county jail for not more than six (6) months.

          (b)  Reckless endangerment that is committed with a deadly weapon or by discharging a firearm into an occupied dwelling is a felony punishable by a fine of not more than Five Thousand Dollars ($5,000.00) and imprisonment for not more than five (5) years.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2022.
