Senate Bill 2400

AN ACT TO AMEND SECTION 63-3-313, MISSISSIPPI CODE OF 1972, TO AUTHORIZE A MOTORCYCLE TO PROCEED THROUGH A RED LIGHT USING DUE CAUTION UNDER CERTAIN LIMITED CIRCUMSTANCES; AND FOR RELATED PURPOSES.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1.  Section 63-3-313, Mississippi Code of 1972, is amended as follows:

63-3-313.  No driver of a vehicle shall disobey the instructions of any official traffic-control device placed in accordance with the provisions of this chapter, unless:

          (a)  At the time the driver is otherwise directed by a police officer; or

          (b)  The driver of a motorcycle at an intersection that is controlled by a traffic-control signal utilizing a vehicle detection device that is inoperative due to the size of the motorcycle.  In this case the driver shall come to a full and complete stop at the intersection and, after exercising due care, may proceed with due caution when it is safe to do so.  It is not a defense to a violation of this section that the driver of a motorcycle proceeded under the belief that a traffic-control signal utilized a vehicle detection device or was inoperative due to the size of the motorcycle when the signal did not utilize a vehicle detection device or that the device was not in fact inoperative due to the size of the motorcycle.

SECTION 2.  This act shall take effect and be in force from and after July 1, 2014.
