AN ACT TO AMEND SECTION 29-1-79, MISSISSIPPI CODE OF 1972, TO REVISE THE PROCEDURE FOR COLLECTION OF PURCHASE MONEY FOR STATE LANDS AND FOR REFUNDS OF SUCH MONEY IF THE PATENT IS NOT TIMELY COMPLETED; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. Section 29-1-79, Mississippi Code of 1972, is amended as follows:
29-1-79. The * * * Secretary of State
shall * * *
receive the purchase money of lands * * * and pay it
into the State Treasury * * *. In the event a patent has
not been finally completed within thirty (30) days after purchase money has
been paid * * *
to the * * * Secretary of State, then, upon written request to
the * * * Secretary of State by the party making * * * the application to purchase state
land, there shall be refunded all money, less fees provided under this chapter,
paid upon * * * the
application to purchase state land. The * * * Secretary of State
shall issue * * * a warrant upon the State Treasurer
for * * * the
sum of money * * * to be refunded. The warrant shall be
paid as all other warrants are paid. The application upon which any money is
refunded shall be void, and no patent shall be granted thereon.
SECTION 2. This act shall take effect and be in force from and after July 1, 2015.
