AN ACT TO REQUIRE THE MISSISSIPPI COMMISSION ON WILDLIFE, FISHERIES AND PARKS TO PUBLISH IN CERTAIN NEWSPAPERS NOTICE OF PROPOSED RULES REGARDING THE REGULATION OF HUNTING, FISHING OR WILD GAME; TO PROVIDE THE CONTENT OF THE NOTICE; TO PROVIDE THAT THE PUBLICATION OF THE NOTICE SHALL BEGIN ON THE DATE THAT NOTICE OF THE PROPOSED ADOPTION OF THE RULES ARE FILED WITH THE SECRETARY OF STATE UNDER THE MISSISSIPPI ADMINISTRATIVE PROCEDURES LAW; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  On the date that notice of the proposed adoption of rules regarding the regulation of hunting, fishing or wild game is filed with the Secretary of State under the Mississippi Administrative Procedures Law, the Commission on Wildlife, Fisheries and Parks shall begin to publish notice of the proposed rule as required by this section.

     (2)  (a)  If the proposed rule applies to only one (1) county in the state, the notice of the proposed rule shall be published at least once a week for at least three (3) consecutive weeks in a newspaper published within the affected county, or if no newspaper is published in the county, then in a newspaper having a general circulation in the county.

          (b)  If the proposed rule applies to every county in the state or applies to more than one (1) county, notice of the proposed rule shall be published at least once a week for at least three (3) consecutive weeks in a newspaper having general circulation in the state or in the counties affected, as appropriate.

     (3)  The size of the notice shall be no smaller than one-fourth (1/4) of a standard newspaper page and shall be printed in bold print.  The notice shall begin as follows:  "The Commission on Wildlife, Fisheries and Parks in the performance of its powers and duties has proposed a new regulation and/or change in rules regarding hunting, fishing or wild game in [here list the county or counties affected or insert the State of Mississippi if the regulation affects every county in the state] as follows: [here insert the language of regulation]."  The notice shall include, in the discretion of the commission, any details relating to the purpose of the regulation and the duration of regulation.  The notice shall contain the procedure for requesting an oral proceeding on a proposed rule under Section 25-43-3.104 of the Mississippi Administrative Procedures Law.

     (4)  The publication of notices under this section shall be subject to the requirements of Section 13-3-31.

     (5)  This section shall be in addition to any requirements of the Mississippi Administrative Procedures Law.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
