AN ACT TO REQUIRE AN INSURER OR A MANAGED CARE ORGANIZATION TO ALLOW POLICYHOLDERS TO RECEIVE TREATMENT FROM ANY HEALTH CARE PROVIDER ON STAFF AT A HOSPITAL LOCATED IN A MUNICIPALITY HAVING A POPULATION OF 10,000 OR LESS IF THAT HOSPITAL IS WILLING TO ACCEPT THE FEE THE INSURER OR MANAGED CARE ORGANIZATION OFFERS, EVEN IF THE HOSPITAL IS NOT IN THE INSURER'S NETWORK OF APPROVED PROVIDERS; AND FOR RELATED PURPOSES.

     SECTION 1.  An insurer or a managed care organization licensed to do business in the State of Mississippi shall allow policyholders to receive treatment from any health care provider having staff privileges at a hospital located in a municipality having a population of Ten Thousand (10,000) or less according to the latest federal decennial census if that hospital is willing to accept the reimbursement fee, terms and conditions for participation in the provision of services which the insurer or managed care organization offers, even if the hospital is not in the insurer's or managed care organization's network of approved providers.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2023, and shall stand repealed on June 30, 2023.
