AN ACT TO CREATE NEW SECTION 99-19-79, MISSISSIPPI CODE OF 1972, TO PROVIDE AUTOMATIC ESCALATION OF PENALTY FOR SUBSEQUENT CRIMINAL OFFENSES WHERE NONE IS SET BY STATUTE; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. The following shall be codified as Section 99-19-79, Mississippi Code of 1972:
99-19-79. Every person who shall be convicted of committing a felony offense in violation of a statute for the violation of which the person has previously been convicted and which statute provides for a maximum penalty less than death or life imprisonment may be imprisoned, in the discretion of the court, for a term of up to twice the term otherwise authorized, fined in an amount of up to twice that otherwise authorized, or both, without regard to the imprisonment or fine imposed for the previous conviction unless the statute setting the penalty for the violation provides some other penalty for a second of subsequent violation thereof.
Nothing contained herein shall be construed to limit in any manner the habitual setting provisions of Section 99-19-8, which shall apply to the maximums set forth herein.
SECTION 2. This act shall take effect and be in force from and after July 1, 2013.
