Senate Bill 2229

AN ACT TO AMEND SECTION 63-3-601, MISSISSIPPI CODE OF 1972, TO PROHIBIT CONTINUOUS TRAVEL BY A MOTOR VEHICLE IN THE OUTERMOST LEFT LANE OF A MULTILANE ROADWAY WHENEVER IT IMPEDES TRAFFIC FLOW; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 63-3-601, Mississippi Code of 1972, is amended as follows:

     63-3-601.  (1)  Upon all roadways of sufficient width a vehicle shall not be driven upon the * * * right one‑half (1/2) outermost left lane of the roadway, except as follows:

          ( * * *1.a)  When overtaking and passing another vehicle proceeding in the same direction under the rules governing such movement;

          ( * * *2.b)  When the right * * * one‑half (1/2) lane or lanes of a roadway * * * is are closed to traffic while under construction or repair;

          ( * * *3.c)  Upon a roadway divided into three (3) marked lanes for traffic under the rules applicable thereon; * * * or

          ( * * *4.d)  Upon a roadway designated and signposted for one-way traffic * * *.;

          (e)  When the right lane or lanes of the roadway are in disrepair or in an otherwise impassable or unsafe condition; or

          (f)  When preparing to exit the roadway on the left.

     (2)  A motor vehicle shall not be operated continuously in the outermost left lane of a multilane roadway when it impedes the flow of other traffic.

     (3)  A violation of this section is a misdemeanor punishable under Section 63-9-11.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2018.
