Senate Bill 2045
AN ACT TO PROHIBIT STATE, COUNTY OR MUNICIPALITY BUILDING CODES FROM RESTRICTING THE USE OF FEDERALLY APPROVED SUBSTITUTE REFRIGERANTS; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. The following shall be codified as a new section within Title 17, Chapter 2, Mississippi Code of 1972:
(1) Neither the State nor any county board of supervisors or municipal governing authority may adopt in its building code or any other requirement applicable to commercial or residential buildings or construction a prohibition against or other limitation upon the use of a substitute refrigerant deemed acceptable under the terms of 42 USCS 771(k).
(2) Nothing in this section shall be construed as prohibiting the State or any county board of supervisors or municipal governing authority from requiring a substitute refrigerant to be listed and installed in accordance with safety standards and use conditions imposed pursuant to such designation.
SECTION 2. This act shall take effect and be in force from and after July 1, 2023.
