House Concurrent Resolution 49

A CONCURRENT RESOLUTION TO ADOPT A NEW JOINT RULE NO. 21A TO PROVIDE THAT NO BILL, CONFERENCE COMMITTEE REPORT, OR CONCURRENCE IN AMENDMENTS ADOPTED BY THE OTHER HOUSE, THAT ADVERSELY AFFECTS BENEFITS OR EMPLOYEE CONTRIBUTION RATES FOR MEMBERS OR BENEFICIARIES OF THE PUBLIC EMPLOYEES' RETIREMENT SYSTEM OF MISSISSIPPI SHALL BE PASSED OR ADOPTED BY EITHER THE SENATE OR HOUSE EXCEPT BY A VOTE OF AT LEAST TWO-THIRDS OF THE MEMBERS OF THAT HOUSE PRESENT AND VOTING; AND FOR RELATED PURPOSES.

     BE IT RESOLVED BY THE HOUSE OF REPRESENTATIVES OF THE STATE OF MISSISSIPPI, THE SENATE CONCURRING THEREIN, That the Joint Rules of the Mississippi Senate and House of Representatives are amended by inserting the following new Joint Rule No. 21A to read as follows:

     21A.  No bill, or conference committee report thereon, or concurrence in amendments adopted by the other house, that adversely affects benefits or employee contribution rates for members or beneficiaries of the Public Employees' Retirement System of Mississippi (PERS) shall be passed or adopted by either the Senate or the House except by a vote of at least two-thirds (2/3) of the members of that house present and voting.  For the purposes of this rule, "adversely affects benefits or employee contribution rates" means:

          (a)  To reduce the benefits of members or beneficiaries of PERS below the level of benefits to which the member or beneficiary would be entitled under law before the effective date of the bill by:

              (i)  Reducing the amount of a retirement allowance provided under Section 25-11-111, Mississippi Code of 1972, or

              (ii)  Reducing the rate or manner used to calculate the amount of the additional payment to retirees and beneficiaries under Section 25-11-112, Mississippi Code of 1972; and/or

          (b)  To increase employee contributions for members of PERS by increasing the employee contribution rate provided under Section 25-11-123, Mississippi Code of 1972, or otherwise requiring additional employee contributions, above the contribution rate in effect before the effective date of the bill.
