House Bill 905

AN ACT MAKING AN APPROPRIATION TO THE RECREATIONAL FACILITIES ACTIVITY PROGRAM FUND FOR THE PURPOSE OF CONSTRUCTING AND MAINTAINING RECREATIONAL FACILITIES ON SCHOOL PROPERTY OR NEARBY COUNTY-OWNED PROPERTY FOR THE FISCAL YEAR 2012; TO PROVIDE THAT THE RECREATIONAL FACILITIES ACTIVITY PROGRAM FUND SHALL BE ADMINISTERED BY THE STATE DEPARTMENT OF EDUCATION; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

SECTION 1.  The following sum, or so much of it as may be necessary, is appropriated out of any money in the State General Fund not otherwise appropriated, to the Recreational Facilities Activity Program Fund established in the State Treasury as a trust fund under House Bill No. ____, 2011 Regular Session, for the purpose of providing the state's contribution to the fund for constructing and maintaining recreational facilities on school property or county-owned or leased property that is easily accessible by schools, for the fiscal year beginning July 1, 2011, and ending June 30, 2012........................ $10,000,000.00.

     SECTION 2.  The funds appropriated under Section 1 of this act shall be administered by the State Department of Education.  The department shall establish a maximum amount of funds that may be provided to a particular county for the purpose of constructing and maintaining recreational facilities on school property or on county-owned or leased property that is easily accessible by schools.

     SECTION 3.  The money appropriated by this act shall be paid by the State Treasurer out of any money in the State General Fund not otherwise appropriated, upon warrants issued by the State Fiscal Officer; and the State Fiscal Officer shall issue his warrants upon requisitions signed by the proper person, officer or officers in the manner provided by law.

     SECTION 4.  This act shall take effect and be in force from and after July 1, 2011.
