AN ACT TO CREATE NEW SECTION 37-153-8, MISSISSIPPI CODE OF 1972, TO REQUIRE THE MISSISSIPPI STATE WORKFORCE INVESTMENT BOARD TO RECOMMEND TO THE MISSISSIPPI OFFICE OF WORKFORCE DEVELOPMENT A PERFORMANCE AND ACCOUNTABILITY SYSTEM FOR THE PURPOSE OF EVALUATING THE EFFECTIVENESS OF CAREER AND TECHNICAL EDUCATION IN THE PUBLIC SCHOOLS; TO REQUIRE THE ACCOUNTABILITY SYSTEM TO INCLUDE CERTAIN METRICS AND PERFORMANCE GOALS WITH TARGET DATES FOR ACHIEVING DESIRED OUTCOMES; TO REQUIRE THE OFFICE TO COMPILE THE MOST RECENT SCHOOL YEAR DATA AVAILABLE NECESSARY TO MEASURE PERFORMANCE UNDER THE ACCOUNTABILITY SYSTEM; TO REQUIRE THE OFFICE OF WORKFORCE DEVELOPMENT, WITH THE ADVICE OF THE EXECUTIVE COMMITTEE OF THE STATE WORKFORCE INVESTMENT BOARD, TO CREATE AN INDEPENDENT REVIEW PANEL TO OBJECTIVELY EVALUATE THE PERFORMANCE OF THE STATE SUPERINTENDENT OF PUBLIC EDUCATION IN ACHIEVING THE GOALS OF THE PERFORMANCE AND ACCOUNTABILITY SYSTEM; TO AMEND SECTION 37-153-17, MISSISSIPPI CODE OF 1972, TO INSERT NEW SECTION 37-153-8, MISSISSIPPI CODE OF 1972, INTO THE LIST OF STATUTES IN THE WORKFORCE TRAINING AND EDUCATION CONSOLIDATION ACT WHICH ARE SUBJECT TO REPEAL; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. The following shall be codified as Section 37-153-8, Mississippi Code of 1972:
37-153-8. (1) The Mississippi State Workforce Investment Board shall recommend to the Mississippi Office of Workforce Development a performance and accountability system for the purpose of evaluating the effectiveness of career and technical education and workforce development in the public schools. The performance and accountability system must establish clearly defined goals for career and technical education programs and provide a means to measure progress toward those goals in order to evaluate and determine if the programs are making a meaningful difference for students throughout the state.
(2) In developing the recommendation, the state board, working with the Office of Workforce Development, shall establish a framework comprised of various metrics with specific performance goals, the outcomes of which are measurable by objective data. The framework must include, but need not be limited to, the following metrics:
(a) Career and technical education work-based learning experience opportunities in public schools;
(b) Nontechnical competencies and skills, such as communication and problem solving;
(c) Credential attainment, including nondegree credentials, such as certifications, licenses and other postsecondary certificates that are not formal college degrees;
(d) Statewide funding levels for students engaged in career and technical education compared to funding levels for students intending to enroll in college after graduation, including the number of students enrolled in career and technical education courses compared to the number of students enrolled in courses in preparation to attend college; and
(e) The statewide total number and overall percentage of school districts demonstrating academic growth under the accountability rating system by improving one or more letter grades during the evaluation term as established by the state board.
(3) For each of the metrics described in subsection (2), the state board shall recommend long range goals and a target date for achieving the desired outcomes. In addition, short and medium term goals with intended targets must be included in order to benchmark progress toward the desired outcome for each metric.
(4) The Office of Workforce Development annually shall compile the data necessary for measuring performance under the performance and accountability system from the most recent school year that such data is available. Upon request from the office, each state agency, department and institution having relevant data must submit the information in the manner and by the date specified by the office.
(5) The Office of Workforce Development, with the advice of the executive committee of the State Workforce Investment Board, shall create an independent review panel for the purpose of objectively evaluating the performance of the State Superintendent of Public Education in achieving the goals set forth in the performance and accountability system established under this section. Following an analysis of the data compiled by the office in relation to the goals and their respective target dates, the independent review panel shall prepare and submit a written report on its evaluation and findings to the Legislature, Governor, Mississippi Office of Workforce Development and the State Board of Education before December 1 of each year, with the first report being due before December 1, 2021.
SECTION 2. Section 37-153-17, Mississippi Code of 1972, is amended as follows:
37-153-17. Sections 37-153-1, 37-153-3, 37-153-5, 37-153-7, 37-153-8, 37-153-9, 37-153-11, 37-153-13 and 37-153-15 shall stand repealed on July 1, 2023.
SECTION 3. This act shall take effect and be in force from and after its passage.
