House Bill 736
AN ACT TO PROHIBIT A LAW ENFORCEMENT OFFICER FROM CARRYING HIS WEAPON ISSUED BY HIS EMPLOYER WHILE SUCH OFFICER IS OFF DUTY; TO PROVIDE A PENALTY FOR VIOLATIONS; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. (1) Except as otherwise provided in Section 17-25-11, it shall be unlawful for a law enforcement officer to carry the service revolver or other weapon issued to him by the employing law enforcement agency for the officer's employment while such officer is off duty and not operating within the scope of his employment. A violation of this section is a misdemeanor punishable by a fine not to exceed One Thousand Dollars ($1,000.00).
(2) Nothing in this section shall prohibit or otherwise restrict a law enforcement officer from carrying a personal weapon in a manner authorized by law.
SECTION 2. This act shall take effect and be in force from and after July 1, 2012.
