House Bill 715

AN ACT TO REQUIRE THE MISSISSIPPI DEPARTMENT OF ENVIRONMENTAL QUALITY TO ADOPT REGULATIONS PROHIBITING THE CURBSIDE PICKUP OF CERTAIN LARGE ITEMS AT RENTAL PROPERTIES; TO REQUIRE REAL PROPERTY LANDLORDS TO BE RESPONSIBLE FOR TRANSPORTING ITEMS OF SOLID WASTE WHICH ARE TOO LARGE FOR CURBSIDE PICKUP TO AN APPROVED SOLID WASTE DISPOSAL FACILITY; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  The Mississippi Department of Environmental Quality shall adopt such regulations as may be necessary to prohibit the curbside collection of items of solid waste which are too large to be contained in a curbside pickup waste disposal storage container.  A landlord or other lessor of real property who generates items of solid waste which cannot be contained within a curbside pickup waste disposal storage container due to the size of the solid waste is responsible for the transportation of such solid waste to a landfill, dump or other disposal facility that is approved by the department for the collection of nonhazardous solid waste.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2020.
