House Bill 673

AN ACT TO REQUIRE A STUDENT ATHLETE AT A PUBLIC UNIVERSITY OR COLLEGE IN THIS STATE TO REPAY ANY ATHLETIC SCHOLARSHIP MONIES RECEIVED IF THE STUDENT ATHLETE SIGNS A PROFESSIONAL-SPORTS-SERVICES CONTRACT OR IS TERMINATED FROM PARTICIPATION IN THE INTERCOLLEGIATE SPORT BY THE UNIVERSITY OR COLLEGE DUE TO DISCIPLINE PROBLEMS PRIOR TO GRADUATING FROM EITHER THAT UNIVERSITY OR COLLEGE OR ANY OTHER UNIVERSITY OR COLLEGE; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  The following words and phrases shall have the meanings ascribed in this section unless the context clearly indicates otherwise:

          (a)  "Intercollegiate sport" means a sport played at the collegiate level for which eligibility requirements for participation by a student athlete are established by a national association for the promotion or regulation of collegiate athletics.

          (b)  "Professional-sports-services contract" means an agreement under which an individual is employed or agrees to render services as a player on a professional sports team, with a professional sports organization, or as a professional athlete.

          (c)  "Student athlete" means an individual who engages in any intercollegiate sport.

     (2)  A student athlete at a public university or college in this state must repay to that university or college any athletic scholarship monies received by that student athlete if the student athlete signs a professional-sports-services contract or is terminated from participation in the intercollegiate sport by the university or college due to discipline problems prior to graduating from either that university or college or any other university or college.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2011.
