MISSISSIPPI LEGISLATURE

AN ACT TO CREATE THE JOINT LEGISLATIVE OVERSIGHT COMMITTEE FOR MEDICAID MANAGED CARE; TO PROVIDE FOR THE MEMBERSHIP AND APPOINTMENT OF THE MEMBERS OF THE COMMITTEE; TO PROVIDE THAT THE COMMITTEE SHALL SUBMIT A REPORT AT THE BEGINNING OF EACH REGULAR SESSION OF THE LEGISLATURE THAT INCLUDES CERTAIN INFORMATION ON ANY MANAGED CARE PROGRAM BEING OPERATED BY THE DIVISION OF MEDICAID; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  There is established the joint legislative oversight committee for Medicaid managed care.

     (2)  The joint committee shall consist of ten (10) members appointed as follows:

          (a)  Two (2) members of the House of Representatives who are members of the Medicaid Committee, to be appointed by the Speaker of the House;

          (b)  One (1) member of the House of Representatives who is a member of the Public Health and Human Services Committee, to be appointed by the Speaker of the House;

          (c)  Three (3) members of the Senate who are members of the Public Health and Welfare Committee, to be appointed by the Lieutenant Governor;

          (d)  Two (2) members of the House of Representatives who are members of the Appropriations Committee, to be appointed by the Speaker of the House; and

          (e)  Two (2) members of the Senate who are members of the Appropriations Committee, to be appointed by the Lieutenant Governor.

     (2)  Members shall be appointed for terms coinciding with the legislative terms for which the members are elected.  All members appointed to fill vacancies in the membership of the joint committee and all members appointed to succeed members appointed to membership on the joint committee shall be appointed in the manner provided for the original appointment of the member succeeded.  The first meeting of the joint committee shall be held before August 1, 2014.

     (3)  The members originally appointed as members of the joint committee shall meet upon the call of the member appointed by the Speaker of the House as the first chairperson within thirty (30) days after the effective date of this act.  The vice chairperson of the joint committee shall be appointed by the Lieutenant Governor.  The chairperson and vice chairperson of the joint committee shall alternate annually between the members appointed by the Speaker of the House and the Lieutenant Governor.  The joint committee shall meet at least two (2) times each year at the call of the chairperson.  Six (6) members of the joint committee shall constitute a quorum.

     (4)  At the beginning of each regular session of the L

Legislature, the joint committee shall submit to the Speaker of the House, the Lieutenant Governor,

the House Medicaid Committee, the House Public Health and Human Services Committee and the Senate Public Health and Welfare Committee a written report that includes, but is not limited to, the following information on any managed care program being operated by the Division of Medicaid:

          (a)  Quality of care and health outcomes of individuals receiving Medicaid services under the managed care program, as compared to the provision of Medicaid services before the implementation of the managed care program;

          (b)  Integration and coordination of health care procedures for individuals receiving Medicaid services under the managed care program;

          (c)  Availability of information to the public about the provision of Medicaid services under the managed care program, including, but not limited to, accessibility to health services, expenditures for health services, extent of consumer satisfaction with health services provided and grievance procedures, including quantitative case data and summaries of case resolution by the managed care program ombudsman;

          (d)  Provisions for community outreach and efforts to promote the public understanding of the managed care program;

          (e)  Comparison of the actual Medicaid costs expended in providing Medicaid services under the managed care program after the implementation of the program to the actual costs expended under the provision of Medicaid services before the implementation of the program, including the manner in which those cost expenditures are calculated; and

          (f)  Comparison of caseload information for individuals receiving Medicaid services before the implementation of the managed care program to the caseload information for individuals receiving Medicaid services under the managed care program after the implementation of the program.

     (5)  The joint committee shall consider the external quality review reports and quality assessment and performance improvement program plans of each managed care organization providing Medicaid services under the managed care program in the development of the report submitted under subsection (4) of this section.

     (6)  The report submitted under subsection (4) of this subsection shall be published on the official website of the Legislature.

     (7)  Members of the committee shall have access to any medical assistance reports and caseload data generated by the Division of Medicaid, and shall have access to any report submitted by the division to the Centers for Medicare and Medicaid Services.

     (8)  Members of the joint committee shall be compensated at the per diem rate authorized by Section 25-3-69 and shall be reimbursed in accordance with Section 25-3-41 for mileage and actual expenses incurred in the performance of their duties with the committee.  Members of the committee shall be paid from the contingent expense funds of their respective houses in the same manner as provided for committee meetings when the Legislature is not in session.  However, no per diem or expense for attending committee meetings will be paid to committee members while the Legislature is in session.  No committee member may incur per diem, travel or other expenses unless previously authorized by vote, at a meeting of the committee, which action shall be recorded in the official minutes of the meeting.

     (9)  The joint committee may make recommendations and proposed legislation as it deems necessary in performing its functions.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
