House Bill 598

AN ACT TO AMEND SECTION 97-25-47, MISSISSIPPI CODE OF 1972, TO PROVIDE FOR THE SEPARATE CRIME OF SHOOTING INTO OCCUPIED CERTAIN TRANSPORTATION FACILITIES; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 97-25-47, Mississippi Code of 1972, is amended as follows:

     97-25-47.  (1)  If any person or persons shall * * *wilfully willfully shoot any firearms or hurl any missile at, or into, any unoccupied train, bus, truck, motor vehicle, depot, station, or any other transportation facility, such person shall, upon conviction, be punished by a fine of not less than One Hundred Dollars ($100.00) nor more than Two Hundred Fifty Dollars ($250.00), or be committed to the custody of the department of corrections not less than one (1) year nor more than five (5) years, or by both such fine and imprisonment.

     (2)  Any person who shall willfully shoot any firearm or hurl any missile at, or into, any train, bus, truck, motor vehicle, depot, station, or any other transportation facility at a time when such train, bus, truck, motor vehicle, depot station or other transportation facility shall be occupied by another person or persons shall be guilty of a felony and shall be punished by imprisonment in the custody of the department of corrections for not less than two (2) years nor more than twenty (20) years and fined not more than Ten Thousand Dollars ($10,000.00), or by both such fine and imprisonment.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2016.
