AN ACT TO REQUIRE LICENSED INSTITUTIONS FOR THE AGED OR INFIRM TO ALLOW END-STAGE RENAL DIALYSIS FACILITIES TO PROVIDE MOBILE DIALYSIS SERVICES ON SITE TO PATIENTS IN THE INSTITUTION SUBJECT TO CERTAIN CONDITIONS; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. An institution for the aged or infirm licensed under Section 43-11-1 et seq. must allow end-stage renal dialysis facilities to provide mobile dialysis services on site to patients in the institution if the dialysis facility: (a) provides its own staff and does not require the services of any staff of the institution for providing the dialysis; (b) provides the appropriate level of care for the patient considering the patient's physical condition; and (c) does not provide dialysis services at any one time for more patients than the authorized number of dialysis stations in the certificate of need issued to the facility.
SECTION 2. This act shall take effect and be in force from and after July 1, 2022.
