AN ACT TO REQUIRE EACH LOCAL SCHOOL BOARD OF A PUBLIC SCHOOL DISTRICT TO ADOPT A POLICY TO ALLOW THE SCHOOL CAFETERIAS TO DONATE FOOD THAT HAS BEEN FROZEN, PROPERLY PRESERVED FOR HUMAN CONSUMPTION OR ANY SURPLUS FOOD ITEMS PREPARED IN THE COURSE OF THE CAFETERIA'S DAILY BREAKFAST AND LUNCH TO LOCAL CHARITABLE ORGANIZATIONS; TO REQUIRE THE EXECUTIVE DIRECTOR OF THE RECEIVING CHARITABLE ORGANIZATION TO AGREE TO A WAIVER OF LIABILITY IN FAVOR OF THE LOCAL SCHOOL BOARD AND THE DONATING SCHOOL CAFETERIA; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  The local school board of each school district shall adopt a policy to allow the public school cafeterias under its authority to dispose of food that has been frozen, properly preserved for human consumption or any surplus food items prepared in the course of the cafeteria's daily breakfast and lunch services through donation to local charitable facilities, charitable organizations and/or individuals providing charitable services as the board deems appropriate.

     (2)  The executive director of the charitable facility or organization, receiving the food, or his authorized designee, shall agree to a waiver of liability in favor of the local school board and the donating school cafeteria stating that the donations are being provided in the condition used by the local school board and the donating school cafeteria, and without warranty of any nature.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2014.
