AN ACT TO PROHIBIT PUBLIC SCHOOLS WHICH RECEIVES FUNDING FROM THE STATE DEPARTMENT OF EDUCATION FROM USING SUCH FUNDS AND LOCAL AD VALOREM CONTRIBUTIONS TOWARDS THE PAYMENT OF ANNUAL PARTICIPATION ASSESSMENT FEES TO THE MISSISSIPPI HIGH SCHOOL ACTIVITIES ASSOCIATION; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. Each public school in the State of Mississippi which receives funding from the State of Mississippi through appropriations made to the State Department of Education for the instruction of students under the adequate education program shall be prohibited from allocating any public school funds, including local ad valorem contributions, for the purpose of paying annual participation assessment fees to the Mississippi High School Activities Association for the participating in any and all extracurricular activities governed by the association. An audit of the school's financial records shall be conducted annually to determine the expenditure of public funds allocated to the school. Upon a finding of inappropriate expenditure of funds for extracurricular participation assessment fees, the school shall be subject to penalization in a manner to be determined by the department. The provisions of this act does not preclude any school from using a source of private funds for participating in activities governed by the Mississippi High School Activities Association.
SECTION 2. This act shall take effect and be in force from and after its passage.
