House Bill 411

AN ACT TO CREATE THE STATE CRIME OF DOMESTIC TERRORISM; TO DEFINE "DOMESTIC TERRORISM"; TO REQUIRE LIFE IMPRISONMENT FOR PERSONS CONVICTED OF DOMESTIC TERRORISM; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  It is unlawful for a person to plan, carry out or attempt to carry out an act of domestic terrorism in this state.  "Domestic terrorism" means an activity that:

          (a)  Involves an act dangerous to human life which is a violation of the criminal laws of this state;

          (b)  Appears to be intended:

              (i)  To intimidate or coerce a civilian population;

              (ii)  To influence the policy of the federal, state or a local government by intimidation or coercion; or

              (iii)  To affect the conduct of the federal, state or a local government by mass destruction, assassination or kidnapping; and

          (c)  Occurs primarily within the territorial jurisdiction of the State of Mississippi.

     (2)  A person convicted of a violation of this section is guilty of a felony and, upon conviction, must be sentenced by the court to imprisonment for life in the custody of the Mississippi Department of Corrections.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2019.
