House Bill 411

AN ACT TO MAKE IT LAWFUL FOR ANY PERSON TO OPERATE AN ALL-TERRAIN VEHICLE ON A COUNTY ROAD IF THE VEHICLE IS EQUIPPED WITH CERTAIN EQUIPMENT AND IF IT IS TRAVELING TO OR FROM PROPERTY OWNED WITHIN A CERTAIN DISTANCE OF RESIDENCE; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  It shall be lawful for any person to operate an all-terrain vehicle on a county road if the following conditions are met:

          (a)  The all-terrain vehicle is equipped with proper headlights, brake lights and a caution sign on the rear indicating it is a slow-moving vehicle; and

          (b)  The operator of the all-terrain vehicle owns a residence along the county road where he is operating the all-terrain vehicle, and he is traveling to or from property he owns located within three (3) miles of his residence.

     (2)  As used in this section, "all-terrain vehicle" or "ATV," means any motorized vehicle manufactured and designed exclusively for off-road use that is fifty (50) inches or less in width, has an unladen dry weight of seven hundred fifty (750) pounds or less, travels on three (3), four (4) or more low pressure tires, has a seat designed to be straddled by the operator and uses handlebars for steering control.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2011.
