House Bill 378

AN ACT TO AMEND SECTION 9-3-29, MISSISSIPPI CODE OF 1972, TO CLARIFY THE DUTIES AND COMPENSATION OF MARSHALS AND DEPUTY MARSHALS OF THE SUPREME COURT AND THE COURT OF APPEALS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 9-3-29, Mississippi Code of 1972, is amended as follows:

     9-3-29.  The Supreme Court may, by order entered on its minutes, appoint a marshal and such deputy marshals as the Supreme Court may deem necessary not to exceed three (3), who shall hold their places during the pleasure of the Supreme Court. They shall attend the sessions of the Supreme Court and the Court of Appeals, and perform all the duties of a sheriff and deputies maintaining order and security for proceedings of the Supreme Court and the Court of Appeals, protecting the justices and judges of the courts, the staff of the courts, and those appearing before and conducting the business of the courts.  Said marshal and deputy marshals shall each receive a salary to be fixed by * * * the Supreme Court * * * within its appropriation.  They shall be paid on a certificate by the chief justice, or by a justice appointed by him to so act, to the Auditor of Public Accounts, who shall issue his warrant for the amount or amounts so certified to the State Treasurer.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2011.
