House Bill 357

AN ACT TO PROHIBIT THE WEARING OF CLOTHING THAT EXPOSES UNDERWEAR OR BODY PARTS IN AN INDECENT OR VULGAR MANNER; TO PROVIDE PENALTIES FOR VIOLATIONS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  It shall be unlawful for any person to wear any clothing that exposes underwear or body parts in an indecent or vulgar manner.  Any person who violates the provisions of this section shall, upon conviction, be warned or punished as follows:

          (a)  For a first or second offense by a verbal warning and if the offender is a minor the parents or guardians shall be notified;

          (b)  For a third offense by a fine of Twenty Dollars ($20.00);

          (c)  For a fourth offense by a fine of Thirty Dollars ($30.00);

          (d)  For a fifth offense by a fine of Forty Dollars ($40.00);and

          (e)  For a sixth or subsequent offense by a fine of One Hundred Dollars ($100.00) and psychological and social counseling by the Department of Human Services and the Department of Mental Health.

     (2)  Violations of Subsection (1) shall be noncriminal citations.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2012.
