AN ACT TO ENACT "CAYLEE'S LAW"; TO CREATE THE OFFENSE OF FAILURE TO REPORT THE DEATH OR DISAPPEARANCE OF A CHILD; TO PROVIDE PENALTIES FOR VIOLATIONS; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. This act shall be known and may be cited as "Caylee's Law."
SECTION 2. (1) Any parent or guardian having the care, custody and control of a child under twelve (12) years of age who knowingly fails to notify law enforcement within twenty-four (24) hours of the death of the child if the child dies under circumstances that would lead a reasonable person to believe that the death occurred as a result of a crime, or the disappearance of the child if the circumstances of the child's disappearance would lead a reasonable person to believe the child was in danger of physical harm, shall be guilty of a misdemeanor or a felony in the discretion of the court and, upon conviction, shall be punished by imprisonment in the county jail for up to six (6) months or by a fine of One Thousand Dollars ($1,000.00), or both, or shall be punished by imprisonment in the custody of the Department of Corrections for not less than one (1) year nor more than five (5) years and by a fine of not less than Five Thousand Dollars ($5,000.00).
(2) Any parent or guardian having the care, custody and control of a child under twelve (12) years of age who knowingly fails to notify law enforcement within twenty-four (24) hours of the disappearance of the child under circumstances other than those described in subsection (1), shall be guilty of a misdemeanor and, upon conviction, shall be punished by imprisonment in the county jail for not less than thirty (30) days nor more than one (1) year and by a fine of One Thousand Dollars ($1,000.00).
SECTION 3. This act shall take effect and be in force from and after its passage.
