House Bill 258

AN ACT TO AMEND SECTION 43-11-25, MISSISSIPPI CODE OF 1972, TO INCREASE THE PENALTIES FOR ESTABLISHING, CONDUCTING, MANAGING OR OPERATING AN INSTITUTION FOR THE AGED OR INFIRM WITHOUT A LICENSE; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 43-11-25, Mississippi Code of 1972, is amended as follows:

     43-11-25.  Any person establishing, conducting, managing or operating an institution for the aged or infirm without a license under this chapter shall be guilty of a misdemeanor, and upon conviction shall be fined not more than One Thousand Dollars ($1,000.00) or imprisoned for not more than one (1) year, or by both such fine and imprisonment, for the first offense.  Upon a second or subsequent conviction, the defendant shall be guilty of a felony and shall be imprisoned for not less than one (1) year nor more than five (5) years and shall be fined not less than Five Thousand Dollars ($5,000.00) nor more than Twenty Thousand Dollars ($20,000.00).

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2012.
