House Bill 1763
AN ACT TO AUTHORIZE THE BOARD OF SUPERVISORS OF TIPPAH COUNTY, MISSISSIPPI, TO REQUIRE THE RIPLEY AND NEW ALBANY RAILROAD COMPANY TO CLEAN ITS RIGHT-OF-WAY(S) IF CERTAIN FINDINGS ARE MADE BY THE BOARD; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. (1) The Board of Supervisors of Tippah County, Mississippi, is authorized, in its discretion, to require the Ripley and New Albany Railroad Company to clean its right-of-way(s) within the county if the board spreads upon its minutes its findings that such cleaning is necessary and is in the best interest of the county to have such right-of-way(s) cleaned.
(2) If the board of supervisors makes the findings as prescribed under this section, then the company shall clean the right-of-way(s) before December 31, 2016.
SECTION 2. This act shall take effect and be in force from and after its passage.
