House Bill 1650

AN ACT TO AUTHORIZE THE GOVERNING AUTHORITIES OF THE CITY OF VICKSBURG, MISSISSIPPI, TO ALLOW THE OPERATION OF MOTOR-ASSISTED ELECTRIC SCOOTERS ON CERTAIN CITY STREETS WITHIN THE CITY OF VICKSBURG; TO DEFINE THE TERM "MOTOR-ASSISTED SCOOTER"; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  (1)  The governing authorities of the City of Vicksburg, Mississippi, is authorized and empowered, in their discretion, to allow the use of motor-assisted scooters to be operated on certain city streets within the City of Vicksburg.

As used under this section a motor-assisted scooter is defined as a self-propelled device, not including pocket bikes or mini-motorbikes with:

          (a)  At least two (2) wheels in contact with the ground during operation;

          (b)  A braking system capable of stopping the device under typical operating conditions;

          (c)  A gas or electric motor not exceeding forty (40) cubic centimeters;

          (d)  A deck designed to allow a person to stand while operating the device;

          (e)  An ability that cannot exceed fifteen (15) miles per hour; and

          (f)  The ability to be propelled by human power alone.

     (2)  Any motor-assisted scooter operated pursuant to this section shall not be operated on any interstate or state highway.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
