House Bill 160

AN ACT TO ENACT "CAYLEE'S LAW"; TO CREATE THE OFFENSE OF FAILURE TO REPORT THE DEATH OR DISAPPEARANCE OF A CHILD; TO PROVIDE PENALTIES FOR VIOLATIONS; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  This act shall be known and may be cited as "Caylee's Law."

     SECTION 2.  (1)  Any parent or guardian having the care, custody and control of a child under fourteen (14) years of age who knowingly fails to notify law enforcement within twenty-four (24) hours of the death of the child if the child dies under circumstances that would lead a reasonable person to believe that the death occurred as a result of a crime or negligence, or the disappearance of the child if the circumstances of the child's disappearance is the result of negligence or the disappearance would lead a reasonable person to believe the child was in danger of physical harm, shall be guilty of a felony and, upon conviction, shall be punished by imprisonment in the custody of the Department of Corrections for not less than one (1) year nor more than five (5) years and by a fine of not less than Five Thousand Dollars ($5,000.00).

     (2)  Any parent or guardian having the care, custody and control of a child under fourteen (14) years of age who knowingly fails to notify law enforcement within twenty-four (24) hours of the disappearance of the child because of negligence or under circumstances other than those described in subsection (1), shall be guilty of a misdemeanor and, upon conviction, shall be punished by imprisonment in the county jail for not less than thirty (30) days nor more than one (1) year and by a fine of One Thousand Dollars ($1,000.00).

     SECTION 3.  This act shall take effect and be in force from and after its passage.
