AN ACT TO CREATE NEW SECTION 71-1-57, MISSISSIPPI CODE OF 1972, TO CLARIFY THAT NEITHER A FRANCHISEE NOR A FRANCHISEE'S EMPLOYEE SHALL BE DEEMED TO BE AN EMPLOYEE OF THE FRANCHISOR FOR ANY PURPOSE; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. The following shall be codified as Section 71-1-57, Mississippi Code of 1972:
71-1-57. (1) Notwithstanding any voluntary agreement entered into between the United States Department of Labor and a franchisor, neither a franchisee nor a franchisee's employee shall be deemed to be an employee of the franchisor for any purpose.
(2) For purposes of this section, the terms "franchisee" and "franchisor" have the same definitions as set out in 16 CFR 436.1.
SECTION 2. This act shall take effect and be in force from and after July 1, 2019.
