AN ACT TO AMEND CHAPTER 947, LOCAL AND PRIVATE LAWS OF 2011, AS AMENDED BY CHAPTER 950, LOCAL AND PRIVATE LAWS OF 2012, AS AMENDED BY CHAPTER 920, LOCAL AND PRIVATE LAWS OF 2013, TO EXPAND  THE BOUNDARIES OF THE MARSHALL UTILITY SERVICES SEWER DISTRICT; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Chapter 947, Local and Private Laws of 2011, as amended by Chapter 950, Local and Private Laws of 2012, as amended by Chapter 920, Local and Private Laws of 2013, is amended as follows:

     Section 1.  (1)  The Board of Supervisors of Marshall County, Mississippi, is authorized and empowered, in its discretion, to establish the Marshall Utility Services Sewer District which shall be composed of * * *a tract of land in Marshall County, Mississippi, being more particularly described as follows:

(a)  All land lying situated in Northwest Marshall County, Mississippi, in Township 1 South, Range 4 West, Township 2 South, Range 4 West and Township 3 South, Range 4 West that has been franchised, designated and granted to Marshall Utility Services by way of certificates of public convenience and necessity issued by the Public Service Commission.

(b)  Begin at a point on the west line of Section 13, Township 1 South, Range 5 West, Marshall County, Mississippi, located 1,200.0 feet, more or less, north of the southwest corner of said section, said point also being located on the Mississippi-Tennessee State line and on the centerline of MS Hwy 309; run thence east along said Mississippi-Tennessee State line a distance of 9.0 section miles to a point on the east line of Section 17, Township 1 South, Range 3 West; run thence south, leaving said Mississippi-Tennessee State line, along said east line a distance of 1,200.0 feet, more or less, to the northeast corner of Section 20, Township 1 South, Range 3 West; run thence south along section lines a distance of 2.0 section miles to the southeast corner of Section 29, Township 1 South, Range 3 West; run thence west along section lines a distance of 1.0 section mile to the southeast corner of Section 30, Township 1 South, Range 3 West; run thence south along section lines a distance of 3.0 section miles to the southeast corner of Section 7, Township 2 South, Range 3 West; run thence west along section lines a distance of 2.0 section miles to the southwest corner of Section 12, Township 2 South, Range 4 West; run thence north along the west section line of said section a distance of 1.0 section mile to the southeast corner of Section 2, Township 2 South, Range 4 West; run thence west along section lines a distance of 6.0 section miles to the southwest corner of Section 1, Township 2 South, Range 5 West located in the centerline of MS Hwy 309; run thence north along section lines and said centerline a distance of 4.0 section miles to the southwest corner of Section 13, Township 1 South, Range 5 West; run thence north a distance of 1,200.0 feet, more or less, along

the west section line of said section to a point, said point being on the Mississippi-Tennessee State line and also being the Point of Beginning of this description if such land has been franchised, designated and granted to Marshall Utility Services by way of certificates of public convenience and necessity issued by the Public Service Commission.

     (2)  The Board of Supervisors of Marshall County, Mississippi, shall be the governing authority for the district.

     (3)  Any portion of the area described in subsection (1) of this section that is presently franchised by Marshall Utility Services, Inc., may be utilized by Marshall Utility Services Sewer District with the permission of Marshall Utility Services, Inc.

     Section 2.  It is declared that the object and purpose of

creating the district is to provide sewer service to the residents

of the area described in Section 1 of this act and to provide ways and means to carry out and accomplish that purpose, thereby benefiting and making more valuable the lands in the district and preserving and promoting the health, safety and convenience of the residents in the district.  In order to carry out and render effective the object and the purpose of this act, the courts of this state shall construe this act as an exercise by the Legislature of all the power appertaining to it that is necessary for the benefit of the health, safety and convenience of the residents of the district.  All the terms and provisions of this act are to be liberally construed to effectuate the purposes set forth in this act and all powers required to accomplish the purposes of this act are granted and conferred.

     Section 3.  The district created pursuant to the provisions

of this act, acting by and through the Board of Supervisors of Marshall County, Mississippi, its governing authority, shall have all powers with respect to wastewater facilities granted to districts by Section 19-5-151 et seq., Mississippi Code of 1972.

     Section 4.  The property and revenue of the district shall

be exempt from all state, county and municipal taxation.

     SECTION 2.  This act shall take effect and be in force from and after its passage.
