AN ACT TO AMEND SECTION 99-3-2, MISSISSIPPI CODE OF 1972, TO PROVIDE FOR CERTAIN PROTECTIONS FOR FEDERAL LAW ENFORCEMENT OFFICERS IN CERTAIN SITUATIONS; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. Section 99-3-2, Mississippi Code of 1972, is amended as follows:
99-3-2. (1) Any United States Marshal or Deputy United States Marshal is authorized in the performance of his duties to bear arms, to make arrests and to make searches and seizures. Whenever any other federal law enforcement officer who is employed by the United States government, authorized to effect an arrest for a violation of the United States Code, and authorized to carry a firearm in the performance of his duties is working in cooperation with local law enforcement officers, the agent shall have the authority in the performance of his duties to bear arms, to make arrests and to make searches and seizures. Any right granted under this section in no way relieves the requirements of appropriate affidavit and search warrant from the appropriate jurisdiction and authority pursuant to the laws of this state.
(2) As used in this section, the term "federal law enforcement officer" means a person who is employed by the United States government, or any department or agency thereof, as a full-time law enforcement officer as defined by the applicable provisions of the United States Code, who is empowered to effect an arrest for violations of the United States Code, who is authorized to carry firearms in the performance of his or her duties, and who has received law enforcement training.
(3) A federal law enforcement officer, whether or not acting according to his special duties, who lawfully exercises any of the powers conferred upon him according to this section, shall be deemed to be acting within the scope of his public employment for purposes of defense and indemnification rights and benefits that he may be otherwise entitled to under the provisions of applicable law.
SECTION 2. This act shall take effect and be in force from and after July 1, 2012.
