House Bill 1417

AN ACT TO AUTHORIZE AN EYEGLASSES DISPENSING FACILITY TO FIT AND DISPENSE EYEGLASSES TO A PERSON WITH A PRESCRIPTION THAT IS MORE THAN TWO YEARS OLD UNDER CERTAIN CIRCUMSTANCES; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Any facility that fits and dispenses eyeglasses to the public may fit and dispense eyeglasses to a person with a prescription that is more than two (2) years old, if the person declares in writing that (a) the eyeglasses that he needs for proper vision are broken or lost, (b) he needs to wear eyeglasses for the safety of himself and others, (c) it is an emergency and he needs to obtain new eyeglasses immediately, and (d) he was not able to meet with a licensed optometrist or a licensed ophthalmologist to obtain a current prescription before coming to the facility.  If the conditions in the preceding sentence are met, the facility shall fit and dispense eyeglasses to the person, using a valid prescription provided by the person or a prescription that is on file at the facility, at the regular price that the facility would charge to a customer under ordinary circumstances.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2010.
