House Bill 1314
AN ACT TO REQUIRE A SEARCH WARRANT TO SEARCH THE DIRECTORY OF A CELL PHONE OR OTHER ELECTRONIC DEVICE OR ANY INFORMATION CONTAINED THEREIN; TO PROVIDE THAT ANY INFORMATION TAKEN WITHOUT A SEARCH WARRANT SHALL NOT BE ADMITTED AS EVIDENCE IN ANY COURT; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. No agent of the state or any political subdivisions thereof shall search the directory of a cell phone or any other electronic device or any information contained therein of any person under arrest or otherwise detained without a search warrant for such cell phone or other electronic device. Any information taken from a cell phone or other electronic device without a search warrant shall not be admitted as evidence in any court in the state.
SECTION 2. This act shall take effect and be in force from and after July 1, 2011.
