House Bill 1285

AN ACT TO AMEND SECTION 11-43-1, MISSISSIPPI CODE OF 1972, TO REQUIRE THE COURT TO RESPOND TO EACH WRIT OF HABEAS CORPUS NO MORE THAN 14 DAYS FROM THE DATE IT IS FILED; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 11-43-1, Mississippi Code of 1972, is amended as follows:

     11-43-1.  (1)  The writ of habeas corpus shall extend to all cases of illegal confinement or detention by which any person is deprived of his liberty, or by which the rightful custody of any person is withheld from the person entitled thereto, except in the cases expressly excepted.

     (2)  The court shall respond to each writ of habeas corpus no more than fourteen (14) days from the date on which it is filed.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2024.
