House Bill 1279

AN ACT TO AMEND SECTION 25-7-37, MISSISSIPPI CODE OF 1972, TO PROVIDE THAT THE COMPENSATION OF THE COUNTY SURVEYOR SHALL BE DETERMINED BY THE BOARD OF SUPERVISORS OF THE COUNTY EMPLOYING SUCH SURVEYOR; TO PROVIDE THAT THE MANNER OF MAKING SUCH COMPENSATION SHALL BE SPREAD UPON THE MINUTES OF THE BOARD; AND FOR RELATED PURPOSES.

     BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:

     SECTION 1.  Section 25-7-37, Mississippi Code of 1972, is amended as follows:

     25-7-37.  * * * County surveyors shall charge the following fees:

  (a)  For each day's attendance in making a survey  15.00

  (b)  For each day spent in the preparation of a plat thereof and statement of contents and certificate of survey  7.50

  (c)  For each day spent in the preparation of additional plats with notes of reference and certificate of survey  5.00

  (d)  For each chain‑carrier, for each day  5.00

  (e)  For recording each survey  2.00.

     The compensation of the county surveyor for services shall be determined by the board of supervisors of the county employing such surveyor.  The manner of making such compensation shall be spread upon the minutes of the board.

     Any fees charged by a county surveyor for noncounty work shall be in an amount equal to the standard fees charged by a private surveyor to a private client for such services.

     SECTION 2.  This act shall take effect and be in force from and after July 1, 2013.
