AN ACT TO AUTHORIZE THE DEPARTMENT OF FINANCE AND ADMINISTRATION, UPON CONSULTATION WITH THE CHAIRMEN OF THE PUBLIC PROPERTY COMMITTEES OF THE MISSISSIPPI HOUSE OF REPRESENTATIVES AND SENATE, TO SELL AND CONVEY THE PROPERTY LOCATED AT 239 NORTH LAMAR STREET IN THE CITY OF JACKSON, HINDS COUNTY, MISSISSIPPI, KNOWN AS THE "ROBERT E. LEE BUILDING"; TO REQUIRE THAT THE CONVEYANCE OF THE PROPERTY MUST BE ACCOMPANIED BY A LONG-TERM LEASE FOR USE OF THE ROBERT E. LEE PARKING GARAGE; TO AUTHORIZE THE DEPARTMENT TO RETAIN ANY EASEMENT ASSOCIATED WITH THE PROPERTIES SOLD AND LEASED UNDER THE PROVISIONS OF THIS ACT FOR HISTORIC PRESERVATION PURPOSES; TO REQUIRE THAT THE MONEY DERIVED FROM THE SALE OF THE PROPERTY BE DEPOSITED IN THE STATE GENERAL FUND; AND FOR RELATED PURPOSES.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MISSISSIPPI:
SECTION 1. (1) After consulting with the Chairmen of the Public Property Committees of the Mississippi House of Representatives and Senate, the Department of Finance and Administration may sell and convey certain state-owned real property known as the "Robert E. Lee Building," located at 239 North Lamar Street in the City of Jackson, Hinds County, Mississippi, and being more particularly described as follows:
Parcel A
A certain parcel of land being a part of 9.4 Acre
Lot 3 north and 10 Acre Lot 2, North according to
H.C. Daniel's Map of the City of Jackson (1875),
Hinds County, Mississippi, and being more
particularly described as follows:
Begin at the Point of Intersection of the South
right-of-way line of Griffith Street and the West
right-of-way line of Lamar Street (as both are now
laid out and improved); said point also being the
Northeast corner of the Robert E. Lee Building; from
said POINT OF BEGINNING, run thence South 00 degrees
30 minutes 19 seconds East along said West right-of-way
line of Lamar Street and along the East face of said
Robert E. Lee Building for a distance of 108.03 feet
to the Southeast corner thereof; run thence South 02
degrees 24 minutes 20 seconds West along said West
right-of-way line of Lamar Street for a distance of
44.86 feet to a point; run thence South 05 degrees
26 minutes 10 seconds West for a distance of 88.16
feet to a point; leaving said West right-of-way
line of Lamar Street, run thence South 89 degrees
44 minutes 31 seconds West for a distance of 147.82
feet to a point; run thence North 00 degrees 07
minutes 46 seconds West for a distance of 241.27
feet to a pk nail on the aforesaid South right-of-way
line of Griffith Street run thence East along said
South right-of-way line of Griffith Street for a
distance of 157.65 feet to the POINT OF BEGINNING,
containing 37,518.81 square feet or 0.861 acres,
more or less.
Parcel B
A certain parcel of land being a part of 9.4 Acre
Lot 3 North and 10 Acre Lot 2 North according to H.C. Daniel's Map of the City of Jackson (1875), Hinds
County, Mississippi, and being more particularly
described as follows:
Commence at the Point of Intersection of the South
right-of-way line of Griffith Street and the West
right-of-way line of Lamar Street (as both are now
laid out and improved); said point also being the
Northeast corner of the Robert E. Lee Building; run
thence West along said South right-of-way line of
Griffith Street for a distance of 157.65 feet to a
pk nail marking the POINT OF BEGINNING of the parcel
of land herein described; from said POINT OF BEGINNING
and leaving said South right-of-way line of Griffith
Street, run thence South 00 degrees 07 minutes 46
seconds East for a distance of 241.27 feet to a point;
run thence South 89 degrees 44 minutes 31 seconds West
for a distance of 155.80 feet to an existing iron pin;
run thence North 00 degrees 57 minutes 45 seconds East
for a distance of 242.0 feet to an existing iron pin
on the aforesaid South right-of-way line of Griffith
Street; run thence East along said South right-of-way
line of Griffith Street for a distance of 151.18 feet
to the POINT OF BEGINNING, containing 37,085.16 square
feet or 0.851 acres, more or less.
Easement
A certain parcel of land being a part of 9.4 Acre Lot 3
North and 10 Acre Lot 2 North according to H.C. Daniel's
Map of the City of Jackson (1875), Hinds County,
Mississippi, and being more particularly described as follows:
Begin at the point of Intersection of the South
right-of-way line of Griffith Street and the West
right-of-way line of Lamar Street (as both are now
laid out and improved); said point also being the
Northeast corner of the Robert E. Lee Building; from
said POINT OF BEGINNING, run thence South 00 degrees 30 minutes 19 seconds East along said West right-of-way
line of Lamar Street and along the East face of said
Robert E. Lee Building for a distance of 108.03 feet
to the Southeast corner thereof; run thence South 02
degrees 24 minutes 20 seconds West along said West
right-of-way line of Lamar Street for a distance of
44.86 feet to a point; run thence south 05 degrees 26
minutes 10 seconds West for a distance of 19.00 feet to
the POINT OF BEGINNING of the parcel of land herein described; from said POINT OF BEGINNING, continue thence South 05 degrees 26 minutes 10 seconds West along said
West right-of-way line of Lamar Street for a distance of 31.52 feet to a point; leaving said West right-of-way
line of Lamar Street, run thence South 89 degrees 47
minutes 31 seconds West for a distance of 151.47 feet
to a point on the line common to parcels A and B; run
thence North 00 degrees 07 minutes 46 seconds West
along said line common to Parcels A and B for a
distance of 25.00 feet; leaving said line common to
Parcels A and B, run thence North 89 degrees 40
minutes 02 seconds East for a distance 18.38 feet to
a point; run thence North 87 degrees 06 minutes 45
seconds East for a distance of 136.30 feet to the
POINT OF BEGINNING, containing 4,247.84 square feet
or 0.098 acres, more or less.
(2) The conveyance authorized in this section shall be accompanied by a long-term lease (up to thirty (30) years) for use of a certain portion of the parking garage which is known as the Robert E. Lee Parking Garage. The parking garage is located immediately west of the property described in subsection (1) and access to which is also granted from other state-owned real property immediately south of the property described in subsection (1). Access to the parking garage is also available directly from Griffith Street. The details of the parking arrangement and access thereto will be formalized in the conveyance document.
(3) The Department of Finance and Administration is authorized to retain in the conveyance of the Robert E. Lee Building and in the lease agreement for the Robert E. Lee Parking Garage any easement for historic preservation purposes.
(4) Money derived from the sale of property authorized under the provisions of this section shall be deposited into the State General Fund.
(5) The State of Mississippi shall retain the right to repurchase the property sold under the provisions of this section if the property is not used, or ceases to be used for the intended purpose, or is otherwise abandoned by the purchaser.
(6) The State of Mississippi shall retain all mineral rights to the real property sold under the provisions of this section.
SECTION 2. This act shall take effect and be in force from and after its passage.
